Board of Trustees Regular Meeting

 

December 5, 2018

 

 

The Village of Elmwood Board of Trustees met in Regular Session on Wednesday, December 5, 2018 at the Elmwood Village Hall. The meeting was called to order at 7:00 p.m.   Chairperson Anderson stated that a current copy of the Nebraska Open Meetings Act was posted; additional meeting documents were available. Roll Call was answered by Brandon Collins, Julie Anderson, Miki Bruns, and Kathy Goerlitz. All signed the “Notice of Acknowledgement of Meeting”. A copy of the proof of publication, as well as the Chairperson and Trustees’ acknowledgement of receipt of notice, are on file.  Notice of the meeting was given in advance thereof by posting in three (3) public places (the Post Office, Village Office, and Elmwood Convenience Store).  Minutes were taken by Connie Carlton, Clerk/Treasurer.

 

 

Approval of Minutes: Motion by Collins with second by Bruns to approve the minutes from the November 21, 2018 meeting as presented.  RCV: Yes: Collins, Bruns, Goerlitz, Anderson; No: None.  Motion approved 4-0.

 

 

Approval of Claims for Payment: A.  American Exchange Bank $5,000 (Street Loan); Bromm Lindahl Freeman-Caddy $750.00 (Legal Fees); Cass County Refuse $65.00 (Refuse service); Columbus Telegram $283.28 (Publications); Elmwood Public Library $2,000.00 (Dec monthly allotment); JEO Consulting Group $4,930.00 (Engineering expense); Michael Todd & Co $226.89 (Street Supplies); NE Rural Water Assn $150.00 (Membership); NMPP $2,013.00 (Software update); Office Depot $596.29 (Supplies); OPPD $3,825.69 (Oct-Nov Electricity Expense); Dec 5 Payroll $3,715.84; Todd Valley Plumbing & Heating $85.00 (Service heater); US Postal Service $150.00 (postage); Windstream $140.49 (Oct-Nov Telephone Expense). Motion by Bruns with second by Goerlitz to approve the claims as presented. RCV: Yes: Collins, Bruns, Goerlitz, Anderson; No: None.  Motion approved 4-0.  B. Dylan Bruns $66.50 (Payroll). Motion by Goerlitz with second by Collins to approve the payroll as presented for Dylan Bruns.  RCV: Yes: Collins, Goerlitz, Anderson; No: None; Abstain: Bruns. Motion approved 3-0.

 

 

New Business:  ORDINANCE NO. 2018-22 – An ordinance to amend Municipal Code Section 3-405 to provide that hearings shall be heard by a hearing officer and clarify process; amend Sections 3-507 and 3-508 to provide an administrative procedure to address due process for disputes under Chapter 3, Article 5; amend Sections 9-401 through 9-403 to adopt the Building Codes adopted by Cass County as the official building codes; to provide that this ordinance shall be published within the first 15 days after its passage and approval either in pamphlet form or by posting in three public places in the Village of Elmwood, Nebraska, and shall be in full force and take effect from and after its passage, approval, and publication, as provided herein; and to provide that this ordinance shall become and be made a part of the Municipal Code of the Village of Elmwood, Nebraska.  Motion by Collins with second by Bruns to dispense with three readings of the ordinance. RCV: Yes: Bruns, Goerlitz, Collins, Anderson; No: None. Motion approved 4-0. Motion by Bruns with second by Collins to adopt Ordinance No. 2018-22 to amend Municipal Code Sections 3-405, 3-507, and 3-508; 9-401 to 9-403. RCV: Yes: Collins, Bruns, Goerlitz, Anderson; No: None. Unfinished Business:  Title search of Buildings 104 to 132 N. 4th Street – Motion by Goerlitz with second by Collins to request title searches of 104 to 132 N. 4th Street properties, not to exceed $100.00 per property. RCV: Yes: Bruns, Goerlitz, Collins, Anderson; No: None. Motion approved 4-0.  Motion by Collins with second by Miki to authorize per Section 3-505 to begin the process of notifications. RCV: Yes: Collins, Bruns, Goerlitz, Anderson; No: None. Motion approved 4-0.

 

 

REPORTS OF BOARDS, COMMISSIONS, AND COMMITTEES:  Street:  Snow removal complete.    Park:  Restrooms winterized.  Library: November meeting minutes presented.  Motion by Bruns with second by Collins to approve the A/P approval report as presented. RCV: Yes: Bruns, Goerlitz, Collins, Anderson; No: None. Motion approved 4-0. Water: Cross Connection surveys were mailed to public and need to be returned by Dec 15th.  Sewer: No report.  Planning/Zoning:  Meeting tomorrow night.

 

 

Public Comment Period: A citizen asked why the public could not comment during the meeting on any subject.  Correspondence:  Discussion of emails.

 

Personnel:  Applications for the PT Maintenance Position were turned over to the Chairperson.

 

 

Retirement of Current Board Sine Die. 

 

Reorganization of the Board:  The newly elected (Becky Kicak) and re-elected Board Member (Miki Bruns) took the Oath of Office as administered by the Village Clerk. 

 

Motion by Kicak with second by Goerlitz to appoint Bruns as Chairperson. RCV: Yes: All; No: None. Motion approved 3-0.

 

Motion by Goerlitz with second by Kicak to appoint JEO Consulting Group as the Village Engineer for the Village of Elmwood.  RCV: Yes: Goerlitz, Kicak, Bruns; No: None. Motion approved 3-0. 

 

Motion by Kicak with second by Goerlitz to appoint Evan B. Wickersham of JEO Consulting Group as the Village Street Superintendent for the Village of Elmwood. RCV: Yes: Kicak, Goerlitz, Bruns; No: None. Motion approved 3-0.

 

Motion by Goerlitz with second by Kicak to appoint Connie Carlton as the Village Clerk/Treasurer for the Village of Elmwood. RCV: Yes: Kicak, Goerlitz, Bruns; No: None. Motion approved 3-0.

 

Motion by Kicak with second by Goerlitz to appoint Maureen Freeman-Caddy as the Village Attorney for the Village of Elmwood; with Slattery Law (Angela Slattery and Julie Baer) for conflicts of interest.  RCV: Yes: Goerlitz, Kicak, Bruns; No: None. Motion carried 3-0.

 

Motion by Goerlitz with second by Kicak to move the appointments of Building Inspector, Nuisance Officer, Hearing Officer, Health Board Officer, Planning Commission Board Members whose terms have expired, and Commissioners to the next meeting. RCV: Yes: All, No: None. Motion approved 3-0.

 

Motion by Goerlitz with second by Kicak to designate the American Exchange Bank as the Village Depository Bank for the Village of Elmwood. RCV: Yes: Bruns, Goerlitz, Kicak; No: None. Motion approved 3-0.

 

Motion by Goerlitz with second by Kicak to designate The Journal as the official newspaper for legal notices for the Village of Elmwood. RCV: Yes: Goerlitz, Kicak, Bruns; No: None. Motion approved 3-0.

Designation of method by which reasonable advanced published notice of the time and place of each meeting of the Board of Trustees is to be given by the Clerk, setting forth the Posting of Notice and the three (3) public places in the Village of Elmwood where the same shall be posted. Motion by Kicak with second by Goerlitz to appoint the three (3) public places for notice as the U.S. Post Office, Elmwood Convenience Store, and the Village Office.  RCV: Yes: Goerlitz, Kicak, Bruns; No: None. Motion approved 3-0.
