Board of Trustees Regular Meeting
September 7, 2016
The Village of Elmwood Board of Trustees met for 2016-17 Budget Hearing and Regular Session with Trustees Anderson, Wray and Krass present with Chairperson Wilhelm presiding. The meeting was called to order at 7:00 p.m. Chairperson Wilhelm declared the “Open Meeting Act” posted. All signed the “Notice of Acknowledgement of Meeting”. Visitors present included Ryan Anderson, Jack Hovick, Clint & Tanner Bornemeier, Eric Beiermann, Lou Allgayer, Aaron Clements, Andy Clements, Beth Philson, Eugenia Bornemeier, Dr. Hufstader, Tim Callaway, Tom Huston, Heather Carver, and Kevin Huxhold. Ed Blunt and Connie Carlton were also present.
Motion by Wray to approve the minutes of the August 17, 2016 Village of Elmwood Board of Trustees meeting as presented; second by Anderson. Vote: Yes: All, No: None; Motion carried.
REPORTS OF BOARDS, COMMISSIONS, AND COMMITTEES: Streets: Discussion regarding South 4th St. report from Evan Wickersham, Street Superintendent. It was decided as a short term fix to fill holes with concrete/rock. Will pursue subject with Nebr Dept of Roads. Park: Equipment has been painted. Library: August A/P Report; motion by Wray to approve the claims as submitted for payment; second by Anderson. Motion approved. Water: Aug Report - Pumped 2,077,000 gallons; Treated 1,863,000 gallons; Wasted RO 214,000 gallons; Average Nitrates 6.6 mgl; Average Daily Usage 67K. Hydrant at 6th/C St inspected; wouldn’t open; scheduled repair in 2 weeks. Motion by Wray to approve the hiring of NE Digging at $150.00 to dig out shut-off at 2nd/W. C St; second by Krass. Motion approved. A leak in alley between Meat Plant and Village Hall has been repaired. Sewer: Routine jetting of mains Sept 13-15 throughout town. Planning/Zoning: Next meeting is scheduled for September 29th at 6:30 pm.
Unfinished Business: Building permit at 320 East C Street by Clint & Tanner Bornemeier – Motion by Anderson to approve the building permit for 320 East C Street with submission of surveyors report; second by Krass. RCV: Yes: All; No: None. Motion approved. RESOLUTION NO. 09072016.4 – A RESOLUTION OF THE BOARD OF TRUSTEES OF THE VILLAGE OF ELMWOOD, NEBRASKA APPROVING AN AMENDMENT TO THE REDEVELOPMENT PLAN OF THE VILLAGE OF ELMWOOD AND A COST-BENEFIT ANALYSIS FOR THE HOUSING REDEVELOPMENT PROJECT. Motion by Wray to approve Resolution No. 09072016.4; second by Anderson. RCV: Yes: Krass, Anderson, Wray, Wilhelm; Nay: None. PASSED AND APPROVED THIS 7TH DAY OF SEPTEMBER, 2016. Eric Beiermann of Olsson Associates presented a water main cost analysis. Bids will be published Sept 15 and Sept 22 in “The Voice” and on “Qwest” with Bid Opening Thursday, Sept 29, 10:00 am at the Village Office. No action taken at this time with bids of village roof replacements from hail damage.
New Business: The 2016-17 Budget Hearing was opened for public comment at 8:52 p.m. No public comment was heard. The 2016-17 Budget Hearing was closed at 8:55 p.m. RESOLUTION NO. 09072016.1 – A RESOLUTION OF THE CHAIRMAN AND BOARD OF TRUSTEES OF THE VILLAGE OF ELMWOOD, NEBRASKA ESTABLISHING THE PROPERTY TAX REQUEST FOR FISCAL YEAR 2016-2017. WHEREAS, Nebraska Revised Statute 77-1601.02 provides that the property tax request for the prior year shall be the property tax request for the current year for purposes of the levy set by the County Board of Equalization unless the Board of Trustees of the Village of Elmwood, Nebraska passes by a majority vote a resolution or ordinance setting the tax request

at a different amount; and WHEREAS, a special public hearing was held as required by law to hear and consider comments concerning the property tax request; and WHEREAS, it is in the best interests of the Village of Elmwood, Nebraska that the property tax request for the current year be a different amount than the property tax request for the prior year. NOW THEREFORE, the Board of Trustees of the Village of Elmwood, Nebraska by a majority vote resolves that: 1. The 2016-2017 property tax request be set at $156,528.00 which would require a tax rate of $0.493573. 2. A copy of this resolution be certified and forwarded to the County Clerk on or before September 20, 2016 as part of the village budget. Motion by Anderson to approve the 2016-2017 property tax request be set at $156,528.00 which would require a tax rate of $0.493573; second by Wray. RCV: Yes: Anderson, Wray, Krass, Wilhelm; No: None. PASSED AND APPROVED THIS 7TH DAY OF SEPTEMBER, 2016. RESOLUTION NO. 09072016.2 – A RESOLUTION OF THE CHAIRPERSON AND THE VILLAGE BOARD OF TRUSTEES OF THE VILLAGE OF ELMWOOD, NEBRASKA INCREASING THE RESTRICTED FUNDS LID BY 1% FOR FISCAL YEAR 2016-2017. WHEREAS, pursuant to Neb. Rev. Stat. 13-519, the Village of Elmwood is limited to increasing its total of budgeted restricted funds to no more than the last prior year’s total of budgeted restricted funds plus population growth plus two and one-half percent expressed in dollars; and WHEREAS, SS 13-519 authorizes the Village of Elmwood to exceed the foregoing budget limit for a fiscal year by up to an additional one percent increase in budgeted restricted funds upon the affirmative vote of at least 75% of the governing body; and WHEREAS, the Annual Budget for Fiscal Year 2016-2017 in the Lid Computation Fiscal Year 2016-2017 supported by the detail relating to restricted revenue accounts, proposes an additional increase in budgeted restricted funds of one percent as provided by statute; and WHEREAS, approval of the additional one percent increase in budgeted restricted funds is prudent fiscal management, does not increase authorized expenditures, and is in the best interests of the Village of Elmwood and its citizens. NOW THEREFORE, BE IT RESOLVED BY THE VILLAGE OF ELMWOOD BOARD OF TRUSTEES: THAT upon affirmative vote by more than 75% of the Village Board, the budgeted restricted funds for Fiscal Year 2016-2017 shall be increased by an additional one percent as provided by Neb. Rev. Stat. 13-519. Motion by Wray to approve an additional one percent increase to the budgeted restricted funds for Fiscal Year 2016-2017 with second by Krass. RCV: Yes: Krass, Anderson, Wray, Wilhelm; No: None. PASSED AND APPROVED THIS 7TH DAY OF SEPTEMBER, 2016. RESOLUTION NO. 09072016.3 – A RESOLUTION TO ADOPT THE BUDGET FOR FISCAL YEAR 2016-2017. BE IT RESOLVED by the Chairperson and Board of Trustees of the Village of Elmwood, Cass County, Nebraska: WHEREAS, a proposed Budget for the Fiscal Year beginning October 1, 2016 through September 30, 2017, was provided to the Village Board on the 7th day of September, 2016. NOW THEREFORE, the Governing Body of the Village of Elmwood, Nebraska, by a majority vote, resolves that: The Budget for the Fiscal Year beginning October 1, 2016 through September 30, 2017 is hereby adopted as the Budget for the Village of Elmwood, Nebraska for said fiscal year. Motion by Krass to adopt the Budget for the Fiscal Year 2016-2017; second by Wray. RCV: Yes: Krass, Wray, Anderson, Wilhelm; No: None. PASSED AND APPROVED THIS 7TH DAY OF SEPTEMBER, 2016. ORDINANCE NO. 2016-015 AN ORDINANCE TO ADOPT THE BUDGET STATEMENT TO BE TERMED THE ANNUAL APPROPRIATION BILL: TO APPROPRIATE SUMS FOR NECESSARY EXPENSES AND LIABILITIES; TO PROVIDE FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CHAIRPERSON AND BOARD OF TRUSTEES OF THE VILLAGE OF ELMWOOD, NEBRASKA: SECTION 1. That after complying with all procedures

required by law, the budget presented and set forth in the budget statement is hereby
approved as the Annual Appropriation Bill for the fiscal year beginning October 1, 2016 through September 30, 2017. All sums of money contained in the budget statement are hereby appropriated for the necessary expenses and liabilities of the Village of Elmwood, Nebraska. A copy of the budget document shall be forwarded as provided by law to the Auditor of Public Accounts, State Capitol, Lincoln, NE and to the County Clerk of Cass County, Nebraska for use by the levying authority. SECTION 2. This Ordinance shall take effect and be in full force from and after its passage, approval, and publication or posting as required by law. Motion by Anderson to approve Ordinance No. 2016-015, termed the annual appropriation bill, with second by Krass. RCV: Yes: Krass, Anderson, Wray, Wilhelm; No: None. PASSED AND ADOPTED THIS 7th DAY OF SEPTEMBER, 2016.
An Elmwood Animal Safety Committee will consist of a Health Representative, a Citizen, and a Board of Trustees member. Motion by Anderson to approve Beth Philson, Amanda Stevens, and Julie Anderson as members of the Animal Safety Board; second by Krass. Motion approved.
A Health Board Committee is being convened with members to consist of the Chairman of the Board of Trustees, a Health Care Provider, Fire Dept member, and possibly the Village Attorney and Building Inspector. Dr. Hufstader and Beth Philson presented their idea of a Community Pantry Box to be located within the Village for citizens to stock or utilize nonperishable food items. Board Member Wray presented the findings of a meeting between herself and Trista Farrens of the Cass County Economic Development. Appointment/approval of new Board of Trustees member – Motion by Chairman Wilhelm to appoint Brody Baer to the Village Board; finishing the term vacated by Louie Allgayer; second by Anderson. RCV: No: Krass, Wray; Yes: Anderson, Wilhelm. Motion not approved. Chairman Wilhelm will present a name for this position at the next meeting.
