Board of Trustees Budget Hearing/Regular Meeting – September 2, 2015

 

The Village of Elmwood Board of Trustees met for the Budget Hearing and Regular Session with Trustees Allgayer, Anderson, Wray, and Chairman Wilhelm presiding. Trustee Krass was absent from the meeting. The meeting was called to order at 7:06 p.m. Chairman Wilhelm declared the “Open Meeting Act” posted. All signed the “Notice of Acknowledgement of Meeting”. Visitors present: Michael Bestwick, David Ernst, Josiah Philson, Rian Harkins (SENDD), Laurel McReynolds, Jim Rust, and Eugenia Bornemeier. Ed Blunt and Connie Carlton were also present.

 

Motion by Allgayer to approve the minutes of the August 12, 2015 CDA Meeting as presented; second by Anderson. Vote: Yes: All, No: None. Motion approved. Motion by Allgayer to approve the minutes of the August 19, 2015 Board Meeting as presented; second by Wray. Vote: Yes: All, No: None. Motion approved.

 

REPORTS OF BOARDS, COMMISSIONS, AND COMMITTEES: Park: “Elmwood” park sign has been installed, as well as a new GaGa Pit. Water: All wells operational. Sewer: Jetting of mains being completed this week. Planning/Zoning: Motion by Allgayer to approve Michael Bestwick as a member to the Planning Committee; second by Wray. Vote: Yes: All, No: None. Motion approved. Next meeting Thursday, September 10th, 7:00 p.m. at the Village Hall. Special Events: Bubble Soccer Event to be held Sunday, Sept 13th at 1:00 p.m. in the Park w/Bar-B-Q at noon.

 

Unfinished Business: A Nuisance Update from SENDD included a PowerPoint presentation               showing nuisance properties; and the progress or lack of progress of several properties. Four property owners asked for additional time to complete the cleanup of their properties. Letters will be sent to additional nuisance properties. The following resolution was read: RESOLUTION 09022015.4 DECLARED NUISANCE. The Board Chairman and Village Board of the Village of Elmwood (hereinafter known as the Village), in regular session assembled at the Village Office Building in Elmwood, Nebraska on this 2nd day of September, 2015 hereby resolve as follows: WHEREAS, the Village desires to declare Nuisances pursuant to the Village Code of Ordinances 4-301 to 4-309. NOW THEREFORE, BE IT RESOLVED that the following properties located within the nuisance jurisdiction of the Village of Elmwood, Nebraska has been submitted to the Village Board at its regular meeting on September 2, 2015: Case #2015-Elm-001 (132 N 4th St), Case #2015-Elm-006 (328 East C St), Case #2015-Elm-007 (320 East C St); and BE IT FURTHER RESOLVED, that the Village Board found at said meeting that the following properties are declared to have nuisances upon them contrary to Elmwood Municipal Code of Ordinances and that said nuisance is ratified by this resolution: Case #2015-Elm-001 (132 N 4th St), Case #2015-

Elm-006 (328 East C St), Case #2015-Elm-007 (320 East C St). BE IT FINALLY RESOLVED, that the Village shall proceed as determined under the administrative procedure of 4-303. INTRODUCED AND PASSED THIS 2nd day of September, 2015. Motion by Wray to approve Resolution 09022015.4 declaring nuisances of the following properties: Case#2015-Elm-001 (132 North 4th St), Case #2015-Elm-006 (328 East C St), and Case#2015-Elm-007 (320 East C St); second by Allgayer. Vote: Yes: All, No: None. Motion approved.

 

Laurel McReynolds thanked the Board for approving the building plans for her new home.

New Business: Chairperson Wilhelm opened the Public Hearing regarding the proposed 2015-2016 budget along with the Special Hearing to set the Final Tax Request at 8:18 p.m. No public comment was heard. Chairperson Wilhelm closed the public budget hearing at 8:25 p.m.

The following resolution was read: RESOLUTION NO. 09022015.1: A RESOLUTION OF THE CHAIRMAN AND BOARD OF TRUSTEES OF THE VILLAGE OF ELMWOOD, NEBRASKA ESTABLISHING THE PROPERTY TAX REQUEST FOR FISCAL YEAR 2015-2016. WHEREAS, Nebraska Revised Statute 77-1601.02 provides that the property tax request for the prior year shall be the property tax request for the current year for purposes of the levy set by the County Board of Equalization unless the Board of Trustees of the Village of Elmwood, Nebraska passes by a majority vote a resolution or ordinance setting the tax request at a different amount; and WHEREAS, a special public hearing was held as required by law to hear and consider comments concerning the property tax request; and WHEREAS, it is in the best interests of the Village of

Elmwood, Nebraska that the property tax request for the current year be a different amount than the property tax request for the prior year. NOW THEREFORE, the Board of Trustees of the Village of Elmwood, Nebraska by a majority vote resolves that: 1. The 2015-2016 property tax request be set at $154,245.90, which would require a tax rate of $0.483516. 2. A copy of this Resolution be certified and forwarded to the County Clerk on or before September 20, 2015 as part of the village budget. PASSED AND APPROVED THIS 2nd DAY OF SEPTEMBER, 2015. Motion by Allgayer to adopt RESOLUTION NO. 09022015.1 as read; second by Wray. RCV: Yes: All, No: None; Absent: Krass. Motion carried.

The following resolution was read: RESOLUTION NO. 09022015.2: A RESOLUTION OF THE CHAIRPERSON AND THE VILLAGE BOARD OF TRUSTEES OF THE VILLAGE OF ELMWOOD, NEBRASKA INCREASING THE RESTRICTED FUNDS LID BY 1% FOR FISCAL YEAR 2015-2016. WHEREAS, pursuant to Neb. Rev. Stat. 13-519, the Village of Elmwood is limited to increasing its total of budgeted restricted funds to no more than the last prior year’s total of budgeted restricted funds plus population growth plus two and one-half percent expressed in dollars; and WHEREAS, SS 13-519 authorizes the Village of Elmwood to exceed the foregoing budget limit for a fiscal year by up to an additional one percent increase in budgeted restricted funds upon the affirmative vote of at least 75% of the governing body; and WHEREAS, the Annual Budget for Fiscal Year 2015-2016 in the Lid Computation Fiscal Year 2015-2016 supported by the detail relating to restricted revenue accounts, proposes an additional increase in budgeted restricted funds of one percent as provided by statute; and WHEREAS, approval of the additional one percent increase in budgeted restricted funds is prudent fiscal management, does not increase authorized expenditures, and is in the best interests of the Village of Elmwood and its citizens. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE OF ELMWOOD BOARD OF TRUSTEES: THAT upon affirmative vote by more than 75% of the Village Board, the budgeted restricted funds for Fiscal Year 2015-2016 shall be increased by an additional one percent as provided by Neb. Rev. Stat. 13-519. PASSED AND APPROVED THIS 2nd DAY OF SEPTEMBER, 2015. Motion by Allgayer to adopt RESOLUTION NO. 09022015.2 as read; second by Wray. RCV: Yes: All, No: None, Absent: Krass. Motion approved.

The following resolution was read: RESOLUTION NO. 09022015.3: A RESOLUTION TO ADOPT THE BUDGET FOR FISCAL YEAR 2015-2016. BE IT RESOLVED by the Chairman and Board of Trustees of the Village of Elmwood, Cass County, Nebraska: WHEREAS, a proposed Budget for the Fiscal Year beginning October 1, 2015 through September 30, 2016, was provided to the Village Board on the 2nd day of September, 2015. NOW THEREFORE, the Governing Body of

the Village of Elmwood, Nebraska, by a majority vote, resolves that: The Budget for the Fiscal Year beginning October 1, 2015 through September 30, 2016 is hereby adopted as the Budget for the Village of Elmwood, Nebraska for said fiscal year. PASSED AND APPROVED THIS 2nd DAY OF SEPTEMBER, 2015. Motion by Wray to adopt RESOLUTION NO. 09022015.3 as read; second by Allgayer. RCV: Yes: All, No: None, Absent: Krass. Motion approved.

The following ordinance was read: ORDINANCE NO. 2015-005: AN ORDINANCE TO ADOPT THE BUDGET STATEMENT TO BE TERMED THE ANNUAL APPROPRIATION BILL: TO APPROPRIATE SUMS FOR NECESSARY EXPENSES AND LIABILITIES; TO PROVIDE FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CHAIRPERSON AND BOARD OF TRUSTEES OF THE

VILLAGE OF ELMWOOD, NEBRASKA: SECTION 1. That after complying with all procedures required by law, the budget presented and set forth in the budget statement is hereby approved as the Annual Appropriation Bill for the fiscal year beginning October 1, 2015 through September 30, 2016. All sums of money contained in the budget statement are hereby appropriated for the necessary expenses and liabilities of the Village of Elmwood, Nebraska. A copy of the budget document shall be forwarded as provided by law to the Auditor of Public Accounts, State Capitol, Lincoln, NE and to the County Clerk of Cass County, Nebraska for use by the levying authority. SECTION 2. This Ordinance shall take effect and be in full force from and after its passage, approval, and publication or posting as required by law. PASSED AND APPROVED THIS 2nd DAY OF SEPTEMBER, 2015. Motion by Anderson to approve ORDINANCE 2015-005 as read; second by Wray. RCV: Yes: All, No: None, Absent: Krass. Motion approved.

 

Jim Rust spoke regarding the tree dumpsite near the Rust Subdivision. He has contacted Dan Schultz of NRD; and they are willing to provide an alternate site southeast of town for the stockpiling of trees. Allgayer will contact Dan Schultz of the NRD and look at proposed site. A kennel permit for 220 North 1st (Carlton): Motion by Wray to approve a kennel permit for 220 North 1st; 2nd by Allgayer. Vote: Yes-Anderson, Wilhelm, Wray; No-Allgayer; Absent: Krass. Motion approved.

Motion by Wray to approve the claims as presented for payment; second by Anderson. RCV: Yes: All, No: None. Absent: Krass. Motion approved.
