Board of Trustees Budget Hearing Meeting – September 18, 2013

 

The Village of Elmwood Board of Trustees met in regular session and for the Budget Hearing with Trustees Allgayer, Clements, Ronhovde, Wilhelm, and Chairman Ernst presiding. The meeting was called to order at 7:02 p.m. All attending signed the “Notice of Acknowledgement of Meeting”. Chairman Ernst declared the Open Meeting Act posted. Ed Blunt, Pat Beckmann, Deanna Sporhase, and James Nelson were also present.

 

Motion by Allgayer to approve the minutes of the September 4th Board Meeting as presented; second by Ronhovde. Vote: Yes: All; No: None. Motion carried.

 

Reports of Boards, Commissions, and Committees:

Streets: The NRD recommends that we contact an engineer for drainage problems on West D Street.

Park: Curfew signs will be replaced in park.

Library: Claims for approval. Motion by Allgayer to approve claims for payment to the US Treasury; second by Ronhovde. Vote: Yes: All; No: None. Motion carried.

Water: Lead/copper level tests normal. Dustrol, Inc completed water purchase of 112,000 gallons for highway construction.

Sewer: Painting hydrants and jetting of sewer lines this week. UV lights to be removed Oct. 1.

Comp/Zoning: No report.

Planning Commission: No report.

Special Events: Event Sept 20th to raise funds for park.

Safety Committee: No report.

To Do List: No report.

 

Old Business: Cost of Weed/Feed for park/library/village office presented. Motion by Ronhovde to approve the purchase of Weed/Feed material at a cost of $277.20; second by Wilhelm. Vote: Yes: All; No: None. Motion carried.

 

New Business: Hearing to Amend the Budget for 2012-2013 opened at 7:30 p.m.

Motion by Allgayer to approve Resolution No. 9182013.1 to amend the previously adopted budget for fiscal year October 1, 2012 through September 30, 2013 (as recommended by auditor); second by Ronhovde. Roll Call Vote: Allgayer: Yes, Clements: Yes, Ronhovde: Yes, Wilhelm: Yes, Ernst: Yes. Motion carried.

Resolution No. 9182013.1: A resolution of the Chairman and Board of Trustees of the Village of Elmwood, Nebraska to amend the previously adopted Budget for fiscal year October 1, 2012 through September 30, 2013. Be it resolved by the Chairman and Board of Trustees of the Village of Elmwood, Nebraska: Whereas, a special hearing was held as required by law to hear and consider comments concerning amending the 2012-2013 budget. Now therefore, the Board of Trustees of the Village of Elmwood, Nebraska, by majority vote, resolves that: The 2012-2013 Budget be approved as amended to increase the Budgeted Disbursements to $658,474.00, to decrease the Necessary Cash Reserve to $158,387.00, and to increase the Total Resources Available to $816,861.00. Passed and approved this 18th day of September, 2013.

Hearing to Amend the Budget for 2012-2013 closed at 7:50 p.m.

 

The Budget Approval Hearing was convened at 7:50 p.m. Discussion regarding the 2013-2014 Budget. Motion by Allgayer to approve Resolution No. 9182013.3 to increase the restricted funds lid by 1% for fiscal year 2013-2014; second by Clements. Roll Call Vote: Allgayer: Yes, Clements: Yes, Ronhovde: Yes, Wilhelm: Yes, Ernst: Yes. Motion passed by 100% margin.

Resolution No. 9182013.3: A resolution of the Chairman and the Village Board of Trustees of the Village of Elmwood, Nebraska increasing the restricted funds lid by 1% for fiscal year 2013-2014. Whereas, pursuant to Neb. Rev. Stat. 13-519, the Village of Elmwood is limited to increasing its total of budgeted restricted funds to no more than the last prior years total of budgeted restricted funds plus population growth plus two and one-half percent expressed in dollars; and Whereas, 13-519 authorizes the Village of Elmwood to exceed the foregoing budget limit for a fiscal year by up to an additional one percent increase in budgeted restricted funds upon the affirmative vote of at least 75% of the governing body; and Whereas, the Annual Budget for the Fiscal Year 2013-2014 in the Lid Computation Fiscal Year 2013-2014 supported by the detail relating to restricted revenue accounts, proposes an additional increase in budgeted restricted funds of one percent as provided by statute; and Whereas, approval of the additional one percent increase in budgeted restricted funds is prudent fiscal management, does not increase authorized expenditures, and is in the best interests of the Village of Elmwood and its citizens. Now therefore, be it resolved by the Village of Elmwood Board of Trustees: That upon affirmative vote by more than 75% of the Village Board, the budgeted restricted funds for Fiscal Year 2013-2014 shall be increased by an additional one percent as provided by Neb Rev Stat 13-519. Passed and approved this 18th day of September, 2013.

Resolution No 9182013.2 was read; motion by Clements to approve Resolution No. 9182013.2 to Adopt the Budget for Fiscal Year 2013-2014; second by Ronhovde. Roll Call Vote: Allgayer: Yes, Ronhovde: Yes, Wilhelm: Yes, Clements: Yes, Ernst: Yes. Motion passed.

Resolution No. 9182013.2: A resolution to adopt the Budget for Fiscal Year 2013-2014. Be it resolved by the Chairman and Board of Trustees of the Village of Elmwood, Cass County, Nebraska: Whereas, a proposed Budget for the Fiscal Year beginning October 1, 2013 through September 30, 2014, was provided to the Village Board on the 18th day of September, 2013. Now therefore, the Board of Trustees of the Village of Elmwood, Nebraska, by a majority vote, resolves that: The Budget for the Fiscal Year beginning October 1, 2013 through September 30, 2014, is hereby adopted as the Budget for the Village of Elmwood, Nebraska for said fiscal year. Passed and approved this 18th day of September, 2013. Budget hearing closed at 8:36 p.m.

 

Resolution No 9182013.4 was read. A motion by Clements to approve Resolution No. 9182013.4 establishing the property tax request for the fiscal year 2013-2014; second by Ronhovde. Roll Call Vote: Clements: Yes, Allgayer: Yes, Ronhovde: Yes, Wilhelm: Yes, Ernst: Yes. Motion passed.

Resolution No. 9182013.4: A resolution of the Chairman and Board of Trustees of the Village of Elmwood, Nebraska establishing the property tax request for fiscal year 2013-2014. Whereas, Nebr Rev Stat 77-1601.02 provides that the property tax request for the prior year shall be the property tax request for the current year for purposes of the levy set by the County Board of Equalization unless the Board of Trustees of the Village of Elmwood, Nebraska passes by a majority vote a resolution or ordinance setting the tax request at a different amount; and whereas, a special public hearing was held as required by law to hear and consider comments concerning the property tax request; and whereas, it is in the best interests of the Village of Elmwood, Nebraska that the property tax request for the current year be a different amount than the property tax request for the prior year. Now therefore, the Board of Trustees of the Village of Elmwood, Nebraska by a majority vote resolves that: 1. The 2013-2014 property tax request be set at $119,428.00, which would require a tax rate of $0.401225. 2. A copy of this Resolution be certified and forwarded to the County Clerk on or before September 20, 2013 as part of the Village Budget. Passed and approved this 18th day of September, 2013.

Ordinance No. 316 was read. A motion by Ronhovde to adopt the budget statement to be termed the annual appropriation bill: To appropriate sums for necessary expenses and liabilities; and to provide for an effective date; second by Clements. Roll Call Vote: Clements: Yes, Allgayer: Yes, Ronhovde: Yes, Wilhelm: Yes, Ernst: Yes. Motion passed.

ORDINANCE NO. 316: AN ORDINANCE TO ADOPT THE BUDGET STATEMENT TO BE TERMED THE ANNUAL APPROPRIATION BILL: TO APPROPRIATE SUMS FOR NECESSARY EXPENSES AND LIABILITIES; TO PROVIDE FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF TRUSTEES OF THE VILLAGE OF ELMWOOD, NEBRASKA: SECTION 1. That after complying with all procedures required by law, the budget presented and set forth in the budget statement is hereby approved as the Annual Appropriation Bill for the fiscal year beginning October 1, 2013 through September 30, 2014. All sums of money contained in the budget statement are hereby appropriated for the necessary expenses and liabilities of the Village of Elmwood, Nebraska. A copy of the budget document shall be forwarded as provided by law to the Auditor of Public Accounts, State Capitol, Lincoln, NE and to the County Clerk of Cass County, Nebraska for use by the levying authority. SECTION 2. This Ordinance shall take effect and be in full force from and after its passage, approval, and publication or posting as required by law. PASSED AND ADOPTED THIS 18TH DAY OF SEPTEMBER, 2013.
