Board of Trustees Regular Meeting – February 20, 2013

The Village of Elmwood Board of Trustees met in regular session with Trustees Ronhovde, Clements, Wilhelm, Allgayer and Chairman Ernst presiding. Call to Order at 7:02 p.m.  All signed the “Notice of Acknowledgement of Meeting”.

Chairman Ernst declared the Open Meeting Act Posted.  James Nelson, Debra McNaught, Robert Pegler, Greg Meyer, Deanna Sporhase, Pat Beckman, Ben Kastens, Shannon Josoff and Nicole Folden were in attendance.  Minutes from the February 6, 2013 meeting were presented and approved.    

At 7:05 p.m. Chairman Ernst called to open the hearing on Elmwood C Store’s Conditional Use Permit Application.  The Board reviewed the recommendation of the Planning Commission and opened the floor to public comment. At 7:08 p.m. Allgayer motioned to close the hearing on Elmwood C Store’s Conditional Use Permit Application, 2nd by Ronhovde.  Yes:  All.  No:  None.  Motion passes to close hearing.  Allgayer motioned to grant conditional use permit to Elmwood C Store for as long as the business operations remain consistent with the purpose of permit applied for.  The Village Board reserves the right to review as the Board deems necessary.  2nd by Wilhelm, RCV:  Yes:  Wilhelm, Ronhovde, Allgayer, Clements and Ernst.  No:  None.

At 7:22 p.m. Chairman Ernst called to open the hearing on 4th Street Market Conditional Use Permit Application.  The Board reviewed the recommendation of the Planning Commission and opened the floor to public comment. At 7:23 p.m. Ronhovde motioned to close the hearing on 4th Street Market Conditional Use Permit Application, 2nd by Wilhelm.  Yes:  All.  No:  None.  Motion passes to close hearing.  Wilhelm motioned to grant conditional use permit to 4th Street Market for as long as the business operations remain consistent with the purpose of permit applied for.  The Village Board reserves the right to review as the Board deems necessary.  2nd by Ronhovde, RCV:  Yes:  Ronhovde, Allgayer, Clements, Wilhelm and Ernst. No:  None.

Three bids on the 2004 Chevy Pickup were presented in the amounts of $11,901.51, $9,900.00 and $7,350.00.  Motion by Allgayer to accept the high bid submitted by Paulsen Auto, $11,901.51.  RCV:  Yes: Ronhovde, Allgayer, Clements, Wilhelm, and Ernst.  No:  None.   Motion passes to accept the high bid for the 2004 Chevy Pickup submitted by Paulsen Auto in the amount of $11,901.51.

Chairman Ernst reported that Blunt was currently at a sewer backup on North 4th Street with Aksarben and unable to attend the meeting.  Blunt’s notes report he ordered more rock. Six new water meters and water supplies were ordered.  Results were received back from monthly sewer samples and all were ok.  The major issue with sewer main on Railroad Avenue was pipe was 80% plugged in a section close to the manhole.  Thirty-six feet of pipe was replaced.

At 7:37 p.m. Chairman Ernst called to open the hearing on Josoff’s d/b/a Red Cedar Lounge.  Conditional Use Permit Application. The Board reviewed the recommendation of the Planning Commission and opened the floor to public comment.  At 8:54 p.m. Allgayer motioned to close the hearing on Josoff’s d/b/a Red Cedar Lounge Conditional Use Permit Application, 2nd by Wilhelm.  Yes:  All.  No:  None.  Motion passes to close hearing.  Allgayer motioned to grant conditional use permit to Josoff’s d/b/a Red Cedar Lounge for as long as the business operations remain consistent with the purpose of permit applied for and approved with the recommendations of the Planning Commission and upon adopting Ordinance 316.  The Village Board reserves the right to review as the Board deems necessary.  2nd by Ronhovde, RCV:  Yes:  Clements, Wilhelm, Allgayer, Ronhovde and Ernst. No:  None.

ORDINANCE #316

AN ORDINANCE TO CHANGE THE ZOINING ORDINANCE OF THE VILLAGE OF ELMWOOD.

BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF TRUSTEES OF THE VILLAGE OF ELMWOOD, NEBRASKA:

To Suspend Section 7.2 Commercial Uses for Districts Zoned for General Commercial Use, until Planning Commission reviews and recommends to replace/amend or alter existing commercial use parking regulations.

Motion by Allgayer to approve Ordinance #316 as read, 2nd by Ronhovde.  RCV:  Yes:  Ronhovde, Wilhelm, Clements, Allgayer and Ernst.  No:  None.  Ordinance #316 passed and approved.

Shannon Josoff reported there will be a run in September bringing approximately 500 people to town.

The Board requests the Planning Commission Review the parking issues and make specific recommendations to the Village Board based upon Ordinance #316 and present their recommendations at the Village Board’s April 3, 2013 meeting.

Wilhelm motioned to approve the claims for payment as presented, 2nd by Ronhovde, RCV:  Yes:  Wilhelm, Ronhovde, Allgayer, and Ernst.  No:  None.  Abstain:  Clements.  Claims approved for payment.

Motion by Allgayer at 9:22 p.m. to enter executive session to discuss the resignation of village clerk and discuss utilities superintendent possible wage increase for obtaining Class IV water license. Seconded by Wilhelm. RCV: Aye: All, Nay: None. Absent: None. Motion passes.

Motion by Allgayer at 10:15 p.m. to exit executive session, 2nd by Wilhelm.  Motion by Allgayer and 2nd by Ronhovde to increase Ed Blunt’s wages $0.75 per hour due to obtaining Class IV water operator license effective February 11, 2013.  RCV:  Yes:  All.  No:  None.

With no further business the meeting adjourned at 10:18 p.m.
